General terms and conditions

The following general terms and conditions apply to all orders from and deliveries by London Tea Co. Ltd (Spalenberg 10, 4051 Basel, CHE-105.902.117), hereinafter referred to as London Tea:

(I) Data protection at London Tea

London Tea complies with the Data Protection Act and endeavors to handle personal data of Internet users with care. The following principles apply to the collection and use of personal data:

Personal Data
Personal data is information that relates to an identified or identifiable individual. This includes information such as name, address, telephone number, e-mail. Both natural and legal persons about whom data is processed are affected.

Obtaining personal data
Data of persons are only collected where they are necessary for the execution of offered services, for orders.

Use ofpersonal data
Personal data collected by London Tea are used only for the purpose of executing the order. London Tea does not disclose personal data to third parties.

Deletion of personal data
Each user may request that data collected about him/her be deleted from the database. E-mail: info@london-tea.ch.

Protection of personal data
The collected data is recorded electronically. London Tea ensures that personal data is protected against unauthorized processing by appropriate technical and organizational measures.

(II) Offer and conclusion of contract

Prices
The prices in our offers and order confirmations are generally binding. However, errors and technical changes are reserved. Indicated instead prices refer to the normal sales price.

Presentation
The presentation of the products in the sales or presentation documents and in the web store does not constitute a legally binding offer by London Tea, but an invitation to the customer to place a binding order (offer to conclude a contract).

Order process
By confirming the order button, the customer places a binding order for the products listed on the order page. The purchase contract is only concluded upon express confirmation of the order by the seller. The confirmation will be sent by e-mail for online orders.

(III) Delivery and shipping costs

Items available from stock are usually delivered within 48 hours. In no case do delays in delivery justify claims for damages or a right to withdraw from the contract. Deliveries or shipping is at the risk of the customer.

(IV) Right of return

Return
Customers have the right to return the goods during 14 days after ordering the goods, provided that the products themselves are in their original packaging or are not broken or opened and undamaged. The right of return is exercised by returning the goods, no justification is required.

Costs ofreturn
The exercise of the right of return leads to the transformation of the purchase contract into a return relationship, according to which the services received under the purchase contract must be refunded. The consumer shall bear the costs of the return shipment.

Refund
After effective receipt and inspection of the goods, provided that they are in perfect condition, the customer will be refunded any purchase price already paid.

Reservation
Reserves a deduction of the purchase price to be refunded or a non-refund of the same and an additional billing for possible damage, excessive wear of the goods or, if agreed, Hinsendkosten of the goods.

(V) Prices / Payment / Retention of Title

Prices of the products
Our prices are net in Swiss Francs (CHF) including value added tax (VAT) and EUR including value added tax (VAT). Prices are subject to change, errors and misprints excepted.

Prices for shipping
In addition to the stated prices, shipping costs may be charged depending on the delivery address, quantity of goods and article.

Shipping with B-Post
Packages are delivered with B-Post as standard. The shipping cost for orders is CHF 7.50 for deliveries in Switzerland and Liechtenstein , free postage fororders over 100. The other shipping costs are rubricated in the section "Delivery & Shipping Costs".

(VI) Terms of payment

Payment with invoice within 30 days
Payment is made against invoice, payable within 30 days. London Tea reserves the right to request an advance payment.

Payment bycredit card
If payment is made by credit card, the customer's account will be charged upon shipment of the goods, unless otherwise agreed. A reservation of the order value is made at the time of ordering.

Discounts
Discounts or discount vouchers (e.g. a voucher with a discount code or a newsletter voucher) can only be redeemed under the terms of the promotion advertised in each case. Several discounts and discount vouchers cannot be combined or accumulated.

(VII) Liability

London Tea is liable for the products delivered and services rendered within the scope of the statutory provisions and the following limitations. Liability for negligence, consequential damages, financial losses or indirect damages is excluded to the extent permitted by law. The same applies to breaches of contract by auxiliary persons and substitutes.

(VIII) Final Provisions

Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.

(IX) Applicable law and place of jurisdiction

Swiss law shall apply. The exclusive place of jurisdiction is Basel.
